TUPE and how it affects you
If you are reading this page of our recruitment web pages, it is likely that you currently work for a company who is transferring some of its activities to Dalkia. Consequently you might be wondering what that means for you and your employment.
The first thing to say is “don't worry!” Here at Dalkia we have extensive experience of managing TUPE and you can rest assured that any contact you have with us as part of a transfer will be managed professionally.
What is TUPE? Well it stands for the Transfer of Undertaking for the Protection of Employment Regulations and is basically legislation which is in place to protect employees when contracts are moved between companies.
In today's business world it is quite common that a contract for the provision of a service, such as maintenance, is handled by one company for a number of years and then following a retender process the business to provide that service is won by another company. When that happens TUPE generally applies to ensure that the employees linked to that service are treated properly and that any employment rights are maintained.
If you work for a company who has service contracts which are in the future going to be provided by Dalkia, there is a process we will follow to ensure a smooth transition occurs. We will liaise with your current employer before undertaking a joint consultation exercise including presentations and one to one meetings so that we can gather all the relevant information about the individuals' employment contracts. Then when we know definitely who is eligible to transfer to us we write out to the individuals to confirm their terms and conditions going forward. In principle each individual retains their existing terms and conditions of employment which they enjoyed with their former employer.
It is complex legislation and we can't go in to all the details here. Just to say if you are affected by TUPE you should in the first instance speak to someone in HR at your current employer.
